1. Parties and Acceptance
These Terms of Service (“Agreement”) govern the relationship between Ysg Bilişim Server Services (“Provider”) and any individual or entity (“Customer”) using our website or customer panel. By accessing the site, registering, or placing an order, you accept these terms.
2. Scope of Services
Provider may offer:
- VDS (Virtual Dedicated Server): Virtual servers on OVH infrastructure (we do not sell VPS)
- Dedicated Servers: Physical server rental
- License Sales: Windows, cPanel, game server, and software licenses
- Domain Services: Registration, renewal, nameserver and DNS management
- Web Design & Development: Project-based websites and software
- Virtual Wallet: Balance top-up and checkout payments
Service scope is limited to the package and configuration selected at checkout.
3. Account and Security
- You are responsible for accurate registration data and keeping it up to date.
- Keep your password confidential and notify us of unauthorized access.
- You are responsible for activity on your account unless unauthorized use is proven.
- We may suspend accounts for suspected abuse or fraud.
4. Orders and Payment
- Prices are as shown on the site and order summary; taxes are stated separately.
- Payment methods include virtual wallet, bank transfer/EFT (after admin approval), and other announced methods.
- Wallet balance is not cash and is used only for platform payments unless law requires otherwise.
- Unpaid orders may be cancelled or held.
5. Delivery
- Server services are provisioned automatically or manually after payment confirmation.
- Domain registrations may be manual or automated for the selected term.
- Licenses are delivered digitally to the customer panel.
- Web design delivery timelines are stated in the proposal/contract.
6. Acceptable Use Policy (AUP)
Services must be used lawfully. Prohibited activities include:
- Illegal content or activity under applicable law
- Spam, phishing, malware, DDoS, port scanning, brute-force attacks
- Copyright infringement, unlicensed software distribution
- CSAM, terrorism propaganda
- Resource abuse affecting other customers
- Unauthorized resale of IP, bandwidth, or resources
Violations may result in suspension, termination, and reporting to authorities.
7. Service Level (SLA)
High availability is targeted through OVH and our operations. Published uptime figures are targets; planned maintenance, force majeure, and customer-caused issues may be excluded. Credits apply only where a written SLA applies.
8. Renewal and Expiry
- Term-based services expire on the end date.
- Renew via the customer panel or support ticket.
- Expired services may be suspended; data may be deleted. Backups are the customer’s responsibility.
9. Cancellation and Refunds
- Digital services and delivered licenses/domains are generally non-refundable after delivery.
- Duplicate or erroneous payments may be reviewed and credited to the wallet where appropriate.
- No refund for termination due to AUP violations.
- Consumer withdrawal rights under Turkish law apply with statutory exceptions for digital services.
10. Intellectual Property
The website, panel, brand, and software belong to Ysg Bilişim. Customers receive limited access for personal/commercial use of purchased services. Customers remain responsible for uploaded content.
11. Limitation of Liability
To the maximum extent permitted by law, Provider is not liable for indirect damages, data loss, lost profits, or business interruption. Total liability may be capped at fees paid for the relevant service in the prior 12 months. Customers must maintain their own backups.
12. Privacy
Personal data is processed under our Privacy Policy.
13. Force Majeure
Neither party is liable for failure due to events beyond reasonable control (natural disasters, war, pandemics, infrastructure failure, cyberattacks, regulatory changes).
14. Governing Law
This Agreement is governed by the laws of the Republic of Türkiye. Disputes are subject to Consumer Arbitration Committees and Consumer Courts for consumers; for merchant customers, Istanbul (Central) courts apply.
15. Changes
We may update these terms. The current version applies from the date published on the website.
